Yes, if the AI wants a scanner there and doesn't have one (on a planet it owns), it is a bit aggressive about building one and will try to build a scanner there on a planet it owns; it doesn't consider relying on capturing an existing scanner. The AI scanner deployment planning is a little rough as it is, sometime when I'm looking at it again I'll try to remember to add that provision.
